Disclosure is a win for the insurance companies

From another sole practitioner:


"It is my opinion that this whole issue is another win for the insurance companies.

If a potential client asks me whether we carry errors or omissions insurance, I will disclose that fact to them and show them and then promptly show them the door.

We are here to help our clients and I ... do not want clients that will feel better knowing they can sue me for my insurance money. ....

I do not know what is up with the State Bar. My clients cannot earn interest money that they have with me in trust, the State Bar is now going with the concept of Permanent Disbarment (no chance of every getting your bar ticket back), and now they want to basically destroy the vast amount of small town lawyers who cannot afford or who cannot obtain insurance.

I thought the State Bar was here to help us? I thought the Court system was there to protect clients against bad lawyers. (Not every lawyer is a bad lawyer!)

I would vote to disband the State Bar and let the California Supreme Court control the system of becoming licensed to practice law in this State.

If this new rule comes is enacted, I may go back into doing legal malpractice work! You mark my words; the number of claims will go up!"
