Is talking negligent?
From today's Wall Street Journal:
Other states already have laws against negligent operation of a vehicle (e.g., eating, putting makeup on, etc. while driving), and talking on the phone while driving falls under this legislative umbrella.
Within the last year, an attorney and her law firm were sued for negligence resulting from a car accident she had while driving and talking on a cell phone. There was a worker's compensation issue as well since the accident took place while the attorney was working.
The judgment against the attorney was $2 million!
Gives pause to the appropriate use of technology!
